1. Acceptance of these terms
These Terms & Conditions (“Terms”) govern your use of themtgstandard.com and any related services we provide (the “Services”). By using our website, requesting a rate quote, submitting an application, or otherwise interacting with us, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.
2. Who we are
“The Mortgage Standard,” “we,” “us,” and “our” refer to The Mortgage Standard LLC, a licensed mortgage broker, NMLS Company ID #2552398. Our principal office is 7265 Dean Martin Dr. #100, Las Vegas, NV 89118.
3. Services we provide
We help residential borrowers compare mortgage products from a variety of lenders and apply for the loan that best fits their situation. Through our website you can:
- Read educational content about mortgage programs (FHA, VA, USDA, conventional, jumbo, refinance, investment property, first-time buyer)
- Use interactive calculators to estimate scenarios such as the cost of waiting to buy or whether buying down your interest rate makes sense
- Request a quote, submit an application, or contact us by phone, email, or form
Use of our website is free. We are paid by lenders or by the borrower at closing as disclosed on your loan estimate.
4. Eligibility
You must be at least 18 years old and a legal resident of the United States to use our Services. By using our Services, you represent that you meet these requirements and that any information you submit is accurate and belongs to you.
5. Application accuracy
You agree to provide truthful, complete, and current information when you apply for a loan or request a quote. Submitting false information on a mortgage application is a federal crime under 18 U.S.C. § 1014. We rely on the accuracy of your submissions, and our lender partners do as well.
You authorize us to verify the information you submit through credit reporting agencies, employers, banks, public records, and other sources, and to share your information with prospective lenders, investors, and service providers as described in our Privacy Policy.
6. Communications and TCPA consent
By providing your phone number, email address, or other contact information through our website, by phone, or by text, you expressly consent to receive communications from The Mortgage Standard at the contact details you provide. This includes:
- Calls and text messages to discuss your application, loan options, rate updates, and related services
- Calls and texts placed using an automatic telephone dialing system, an artificial or prerecorded voice, or AI-assisted dialing
- Emails about your application, our services, and (with your consent) marketing
This consent is not a condition of receiving a loan or any other service from us, and you can revoke it at any time. To opt out of marketing texts, reply STOP. To opt out of marketing emails, click the unsubscribe link in any email. To opt out of marketing phone calls, tell our representative during a call. Standard message and data rates may apply. Message frequency varies.
7. Equal credit opportunity and fair lending
The Mortgage Standard is an Equal Housing Lender. We make credit available without regard to race, color, religion, national origin, sex, marital status, age (provided the applicant has the capacity to contract), receipt of public assistance, or the good faith exercise of any right under the Consumer Credit Protection Act, as required by the Equal Credit Opportunity Act (ECOA) and the Fair Housing Act.
8. State licensing and NMLS
The Mortgage Standard LLC is a licensed mortgage broker in Nevada and Texas. Loans we originate are subject to state and federal mortgage laws, including state-specific licensing rules and consumer protections. 9. No guarantees of approval
Submitting an application does not guarantee loan approval. All loans are subject to credit approval, underwriting, appraisal, income and asset verification, and other conditions imposed by the lender. Rates and program terms shown on our website are illustrative and may not reflect the rate or terms you ultimately receive.
10. Third-party content and links
Our website may contain links to third-party websites, content, or services we do not control. We are not responsible for their content, privacy practices, or availability. Following any third-party link is at your own risk.
11. Our intellectual property
All content on themtgstandard.com (including text, graphics, logos, photographs, calculators, code, and design) is owned by or licensed to The Mortgage Standard LLC and is protected by copyright, trademark, and other intellectual property laws. You may view and print pages for personal, non-commercial use, but you may not copy, modify, distribute, or reproduce our content for commercial purposes without our written permission.
12. Content you submit
If you submit reviews, testimonials, comments, or other content to us (“User Content”), you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, display, and distribute that content in connection with our Services. You represent that you own the User Content you submit and that it does not infringe any third-party rights.
13. Disclaimers
Our Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including any warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, or that the Services will be uninterrupted or error-free. The information on our website, including calculator outputs, is for educational purposes and does not constitute a loan commitment, financial advice, tax advice, or legal advice.
14. Limitation of liability
To the fullest extent permitted by applicable law, in no event will The Mortgage Standard, its members, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, loss of data, or loss of goodwill, arising out of or in connection with your use of the Services, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or relating to the Services will not exceed $100, unless required otherwise by law.
15. Indemnification
You agree to indemnify and hold harmless The Mortgage Standard and its members, employees, and agents from any claim, demand, loss, or damage (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.
16. Termination
We may suspend or terminate your access to our Services at any time, with or without notice, for any reason, including violations of these Terms. You may stop using our Services at any time. Provisions of these Terms that by their nature should survive termination will survive (including disclaimers, limitations of liability, and dispute resolution).
17. Governing law
These Terms and any disputes arising out of or relating to them are governed by the laws of the State of Nevada, without regard to its conflict-of-laws principles. Federal mortgage and consumer-protection laws also apply where they govern.
18. Dispute resolution
If you have a dispute with us, please contact us first so we can try to resolve it informally. If we cannot resolve it within 60 days, both parties agree that any unresolved dispute will be brought in the state or federal courts located in Clark County, Nevada, and you and we consent to the personal jurisdiction of those courts. This section does not affect any non-waivable rights you may have under applicable consumer-protection law.
19. Changes to these terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. Your continued use of the Services after the changes take effect means you accept the updated Terms. If a change materially reduces your rights, we will provide additional notice.
